1. General
1.1 These terms and conditions of sale and delivery apply to the sale and delivery of the products listed on the website https://www.timeisyours.ch. Please read these terms and conditions of sale and delivery carefully before ordering products from this website. By ordering our products, you agree to the following provisions.
1.2 Please click on the “I agree” button at the end of the ordering process if you agree to these terms and conditions of sale and delivery. Please understand that if you reject these terms and conditions of sale and delivery, you will not be able to order any products from this website.

2. Your Status
2.1 By placing an order through our website, you warrant that:
2.1.1 you are capable of entering into legally binding contracts;
2.1.2 you are at least 18 years old.

3. Purchasing Goods, Ordering Process
3.1 Your order of a product on this website constitutes an offer to purchase the product subject to these Conditions of Sale and Delivery.
3.2 After you have placed an order, you will receive an E -Mail to confirm that we have received your order. We will also send you all the information about prepayment. Please note that this does not mean that your order has been accepted as all orders are subject to our acceptance. For transaction security and fraud prevention purposes, we reserve the right, prior to accepting your order, to require you to:
- confirm certain information about your order to us over the phone
- provide us with proof of your identity (e.g. a copy of your ID).
If you do not comply with this request within the period specified, if applicable, we reserve the right to cancel your order.
3.3 We accept no liability for any errors in the image material or spelling on this website .
3.4 As our watches are made to order, we do not have any items in stock. The delivery dates will be communicated on our website.
3.5 We will confirm acceptance of your order by sending you an order confirmation by e-mail. This creates a binding contract between you and us.
3.6 The contract only relates to those products whose dispatch we have confirmed in the order confirmation. We are under no obligation to deliver any other products that may have been part of your order, unless the shipment of those products has been confirmed in a separate order confirmation.

4. Price and payment
4.1 The price of a product is as it appears on this website, except in cases of obvious error. Before the order is placed, the individual prices including the shipping costs incurred (if any) are shown separately and as a total price.
4.2 Even if we try to the best of our ability, it is always possible that some of the products listed on our website are not are listed with the correct price. We normally verify the accuracy of prices as part of our transit process. If the correct price of a product is lower than the price we quote, we will charge the lower amount when shipping the product.If the correct price is higher than the price stated on the website, we will, at our discretion, either contact you prior to dispatching the product or refuse your order and notify you of this refusal
4.3 We are under no obligation to deliver any product deliver to you at an incorrect (lower) price where the pricing error is obvious and unmistakable and could reasonably have been recognized by you as an incorrect price, even if we have already sent you an order confirmation with the incorrect price.
4.4 Payment done by bank transfer or credit card. We will state the price to be paid by you in the order confirmation. Payment must be made before delivery of the products. We will delay delivery of the Products until full payment has been received. If delivery becomes impossible or if you withdraw from the purchase contract, the purchase price will be refunded to you as soon as possible. You will have to bear any fees that may arise from this and your house bank or your credit card provider.

4.5 Retention of title; On Bill; Right of retention: A- In the case of consumers, we reserve ownership of the purchased item until the invoice amount has been paid in full. If you are an entrepreneur exercising your commercial or self-employed professional activity, a legal entity under public law or a special fund under public law, we reserve title to the purchased item until all outstanding claims from the business relationship with the customer have been settled. The corresponding security rights can be transferred to third parties.
B- You only have the right to offset if your counterclaims have been legally established or are undisputed or recognized by us. In addition, you only have a right of retention if and to the extent that your counterclaim is based on the same contractual relationship. C- If the customer is in arrears with any payment obligations towards us, all existing claims are due immediately.

5. Delivery
5.1 The current delivery date will be published on our website and will be announced to you together with the order confirmation.
5.2 The place of delivery corresponds to the information in the order confirmation. For convenience, we may ship multiple products from the same order in multiple split shipments; we will inform you of this with the dispatch note. If this increases the shipping costs, we will only do so without your consent if you were informed of these increased shipping costs when the contract was concluded.
5.3 If we are unable to meet the estimated delivery date stated in the order confirmation and the corrected delivery date is no longer is within 30 days of the order date, we will contact you immediately to inform you of the new delivery date.

6. Transfer of Title and Risk
6.1 Title to the Product shall pass to you upon full payment of the full purchase price (including shipping and handling) or upon delivery of the Product, whichever occurs later. We may reclaim delivered products at any time prior to the transfer of ownership if you breach these Terms and Conditions of Sale and Delivery.
6.2 The risk of the product passes to you upon delivery. Danger, as used in this provision, means responsibility for damage to the product or its use, handling or storage.

7. Right of withdrawal and consequences of withdrawal
7.1 You can withdraw your contractual declarations within 10 days without giving reasons in text form (e.g. letter, fax, email) after the full purchase price has been transferred.The period begins on the day after receipt of the purchase price. In order to meet the cancellation deadline, sending the cancellation or the goods in good time is sufficient. 8. Warranty
8.1 In the event of any damage or defect in any product, Zahnd & Kormann GmbH will, at its sole discretion, promptly repair the product after the damaged or defective product is returned.
8.2 Watch Warranty: All on this website for sale The watches offered come with a 24-month international guarantee from Zahnd & Kormann GmbH for material or manufacturing defects that already existed before the goods were shipped. Zahnd & Kormann GmbH assumes no liability for damage resulting from improper handling or damage from use. The following components of the watch are explicitly excluded from the guarantee:

Damage caused by improper, excessive or unusual use.
Battery (if present)
crown
Watch strap
Improper repairs

8.3 Warranty claims can be made either through an authorized Zahnd & Kormann dealer or by returning the product to Zahnd & Kormann. Warranty claims must be accompanied by proof of purchase confirming the date of purchase. The following documents are accepted as proof of purchase:
8.3.1 an international guarantee certificate stamped and dated,
8.3.2 the original of the sales receipt or delivery note,
8.3.3 a bank or credit card statement.
8.4 In the absence of proof of purchase, we will only provide an appropriate guarantee on a product based on the length of time it has been available.
8.5 Returns of products based on this guarantee must be sent by parcel post to the following address be sent to:

8.6 This guarantee in no way limits the warranty rights to supplementary performance, reduction, withdrawal and compensation for damages that the buyer has from to be entitled by law

9. Liability
9.1 Zahnd & Kormann GmbH is liable for claims for damages arising from warranty and other legal grounds - in particular claims from tort, organizational fault, fault at the conclusion of the contract or any other fault-related claims from breaches of duty - only insofar as Zahnd & Kormann or their vicarious agents intent or gross negligence or liability is based on claims under product liability law. The above exclusion of liability for cases of simple negligence does not apply to damage resulting from injury to life, limb or health or in the case of fraudulent concealment of a defect.

10. Miscellaneous
10.1 Transfer of rights and obligations. The contract between you and us is binding on you and us and on our respective successors. You may not transfer, assign, encumber or otherwise dispose of the right to delivery of the ordered goods under this contract without our prior written consent.
10.2 Severability clause. Should one of the provisions of these terms of sale and delivery be or become invalid or unenforceable, the validity of the remaining provisions shall not be affected.
10.3 Electronic communication. If you use our website, you agree that communication with us - to the extent permitted by law - takes place electronically. We will contact you by email at the email address you have provided or by post at the address you have provided.

10.5 Place of jurisdiction and applicable law. These terms of sale and delivery are subject to Swiss law. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.
10.6 To the extent permitted by law, Berne is the exclusive place of jurisdiction for all disputes arising from these terms and conditions of sale and delivery. Zahnd & Kormann is also entitled to sue at the customer's place of business.
